OAC Release, Waiver of Liability and Indemnity Form

With intent to be legally bound, and in consideration of OAC’s permission to allow participation in events, Participant agrees as follows:

Participant, on behalf of himself/herself and his/her heirs, executors, administrators, and assigns, fully releases and discharges OAC and its successors and assigns from all rights, claims and actions that Participant and Participant’s above-described successors now have or may have against OAC and OAC’s above-described successors arising out of the event sponsored by OAC.  Participant waives all claims against OAC and further agrees to indemnify and hold harmless OAC, its Board of Trustees, officers, directors, staff, agents and employees, against all claims, suits, liabilities, costs, damages and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (i) Participant’s participation in OAC-sanctioned events; or (ii) any loss, injury, death or damage to persons by reason of any act, omission or negligence of Participant, or any of its agents, its contractors, its employees, licensees, or invitees.

This release is intended to release all claims that Participant may have against OAC for liability for injuries, damages, or losses to Participant’s person and property, real or personal, whether known, unknown, foreseen, or unforeseen. Participant understands and acknowledges the significance and consequence of the specific intention to release all claims, and assumes full responsibility for any injuries, damages, or losses that may arise out of the above-described circumstances.

This release is freely and voluntarily executed by Participant after being apprised of all relevant information and data furnished by OAC. In executing this Release, Participant does not rely on any inducements, promises, or representations made by OAC.

Participant gives permission to OAC to use photographs, audio and video recordings, and facsimile images of Participant, without compensation, for promotional activities. Participant agrees to hold OAC free and harmless from all claims arising from the use of said promotional material. Participant also gives OAC permission to contact participant via participant info provided regarding the events information and updates. 

With full awareness and appreciation of the risks involved, participant, for its self and on behalf of its family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue the Company, its board members, officers, agents, servants, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by participant related to COVID-19 whether caused by the negligence of the Released Parties, any third-party, or otherwise, while participating in any activity or responsibility arising out of the nature of this Agreement. 

Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to the performance of participant under this Agreement, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

By signing below, Participant acknowledges and represents that it has read the foregoing Waiver of Liability, understands it and signs it voluntarily as its own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; no oral representations, statements, or inducements apart from the foregoing written agreement, have been made.

The participant has read this Release and understands it in its entirety. 

In the event Participant is not age eighteen (18) years or older, this Release shall be executed by the adult legally responsible for Participant. Execution of this Release shall be prima facie evidence that this Release was executed by Participant or Participant’s legally responsible adult. 

Ohio Athletic Committee Sportsmanship Policy

In the effort to increase the quality of this OAC event, we would ask that you as a coach/parent/fan please read through our expectations on Sportsmanship.

Fundamentals of Sportsmanship

  • Show respect for self and others at all times.
  • Respect the officials. Have the willingness to accept and abide by the decisions of the officials.
  • Have a basic understanding, and appreciate the rules of the contest.
  • Maintain self-control at all times.
  • Recognize and appreciate skill in performance of all participants and tournament staff.
  • Any un-sportsmanlike conduct by a person present at an OAC event may result in a penalty up to and including a one-year ban from any OAC event. If the un-sportsman act is by a coach, parent, family member or anyone connected to a particular athlete the ban could also include the athlete. We will have a zero tolerance for un-sportsmanlike behavior.

Examples of Un-Sportsmanlike Behavior

  • Yelling obscenities at officials, workers, fans, opponents and/or your participant.
  • Abusive behavior directed at officials, workers, fans, opponents and/or your participant.
  • Allowing your participant to throw equipment.

We ask that you hold yourself in the highest standard of sportsmanship. Please set an example for the young men/women whom you coach. Please do not put your participant at risk for disqualification due to your behavior.

Ohio’s Return-to-Play and Lindsay Laws

The State of Ohio has enacted legislation designed to protect student athletes.  These laws require parents of student-athletes to view short training videos, which can be found on the Ohio Department of Health website (odh.ohio.gov).  The OAC believes strongly in the safety of all of its participants.  Parents of our participants must complete these trainings prior to entering their child into any OAC event.

Infectious Disease Wavier 
I attest that I am the parent/guardian of the individual listed below. As lawful consideration for my child being permitted to participate in the sporting event, which may or not be hosted by the Ohio Athletic Committee (OAC), I understand, acknowledge, and agree that:

 

  1. Participation in such events or activities by my child and/or myself involves possible exposure to and illness from infectious and/or communicable diseases including, but not limited to, COVID-19, MRSA, Influenza, and other communicable diseases. While adherence to rules and requirements may reduce the risk of possible exposure, the risk of serious illness and death remains; and
  2. On behalf of my child and/or myself, I knowingly and freely ASSUME ALL SUCH RISKS, both known and unknown, even if arising from the negligence of the releasees of others, and assume full responsibility for my participation; and
  3. On behalf of my child and/or myself, I agree to comply with all rules, regulations or conditions established by the OAC and the State of Ohio for participating in such events or activities; and
  4. On behalf of my child and/or myself, I for myself and on behalf of my heirs, assigns, personal representative and next of kin, HEREBY RELEASE AND HOLD HARMLESS the OAC, sponsors, venue, and all others associated with the event (“RELEASEES”), from and against any and all claims of whatever type or kind including any illness, death, disability, or other loss or damage to personal property, whether arising from the negligence of Releasees or otherwise to the fullest extent permitted by law. Further, I expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of the State of Ohio or any other state in which my child and/or myself may participate in any event or activity described herein, and that if any portion of this release is determined to be invalid, it is agreed that the remaining provisions of this release shall continue in full force and effect. Finally, I further state that I have fully and carefully read the above release, understand the contents of the same and sign this release voluntarily as of my own free act and deed.

For Parents/Legal Guardians of Participants Under 18 Years of Age

I hereby warrant, affirm, and represent that I am the parent/legal guardian with legal responsibility for the above-named participant who is under 18 years of age and that, in such capacity, I have read this Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement completely and carefully, understand the risks involved with the events, activities, and programs offered, conducted, and sponsored by facilities including Cedar Point Sports Center & Ripken Parks, have explained and discussed those risks with the above-named participant, and do hereby consent and agree to his/her participation, release, waiver, and acceptance of risk as provided above. On behalf of myself, the above-named participant, and my family, personal representatives, estate, successors, assigns, heirs, executors, and next of kin, I hereby knowingly, freely,and expressly agree to all of the terms and conditions of this Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement.
